Mom Sues City In September Shooting Death of Son



CHICAGO -- The mother of a 17-year-old boy fatally shot by Chicago Police last September filed a wrongful death lawsuit against the city of Chicago, claiming the use of deadly force by officers was unwarranted.

Demetria Williams filed in Cook County Circuit Court on behalf of her son, Marvin Williams, following his death on Sept. 16, 2008.

Marvin, of South Oakley Ave., was shot at 7000 S. Bishop St. and was pronounced dead at Advocate Christ Medical Center in Oak Lawn, according to the Cook County Medical Examiner’s office.

The suit claims Marvin was inside a car near 70th and Bishop streets when he was placed under arrest. As officers attempted to arrest him, an officer's gun discharged and struck Marvin, the suit said.

The suit claims police employed unnecessary deadly force, intentionally discharged a weapon while pointed at Marvin, recklessly took off the safety of the weapon as it was pointed at Marvin and employed deadly force when officers where not in danger of harm or death.

The four-count suit, which also claims survival action, false arrest and false imprisonment, seeks more than $50,000 in damages.
