Suspect Nabbed For 12-year-old Sex Crime




LISLE --  Police, with assistance from law enforcement officials in Georgia, have brought a 37-year-old man back to DuPage County, where he will stand trial for a nearly 12-year-old sex crime.  

Mexican national Martiniano Montes-Deoca, then 25, was arrested Oct. 7, 1996, and charged with two felony counts of criminal sexual assault, Lisle police Sgt. Ron Wilke confirms.

Wilke said Montes-Deoca at the time was living with a woman in an apartment building at 5495 Burr Oak Road. The woman’s pregnant sister was living with them.

Montes-Deoca “basically came home one night intoxicated” and “forced himself” on his girlfriend’s sister, Wilke said. The woman reported the attack to police, who then arrested him.

Wilke said Montes-Deoca was freed soon after on $15,000 bail and was scheduled to appear in court for arraignment. He instead vanished, and “all attempts to locate Montes-Deoca ... met with negative results,” Wilke said.

The trail remained cold until Aug. 18, 2003, when Montes-Deoca was arrested for amphetamine-trafficking in Clayton County, Ga., Wilke said. Authorities there learned of the outstanding warrant for Montes-Deoca’s arrest in Illinois and contacted Lisle police.

Wilke said police were unable to locate the alleged assault victim until June 16. She indicated she was willing to testify against Montes-Deoca in his upcoming trial here, Wilke said.

The woman was found only two days before Montes-Deoca was scheduled to be paroled from prison in Georgia, after serving half of his 10-year drug-trafficking sentence.

Wilke said Lisle police detectives took custody of Montes-Deoca at the prison in Unadilla, Ga., and brought him back to Illinois.

Criminal sexual assault is a Class I felony. It carries a potential penalty of  4-to-15 years in prison upon conviction.
If Montes-Deoca is found guilty of the alleged sexual assault, he will serve time in prison before facing deportation proceedings brought by U.S. Immigration and Customs Enforcement agents. He faces immediate deportation to Mexico if acquitted.

Montes-Deoca remains in DuPage County Jail in Wheaton. A bond hearing is scheduled for Tuesday when courts reopen.
