Parents of Girl Killed in Chinatown CTA Crash Sue Driver



CHICAGO -- The parents of an 18-year-old girl killed after a semi truck crashed into the Chinatown CTA station last Friday have filed a wrongful death suit against the driver of the truck and his employer.
Jerry and Wanda Brown, parents of Delisia Brown, filed a suit in Cook County Circuit Court against Donald Wells and Whiteline Express Ltd., accusing the 64-year-old driver of negligence.
Brown and 47-year-old Elosia Guerrero were killed and more than 20 people were injured, including six children, after a semi truck crashed into the Cermak/Chinatown CTA station at 138 W. Cermak Rd. about 5:20 p.m.
The suit makes several accusations against Wells including that he was negligent in operating the tractor trailer in a safe manner, failed to reduce speed, failed to yield the right of way to pedestrians and failed to observe a traffic light.

The semi truck, driven by Wells, came off the feeder ramp crossed Cermak Road, shattered the bus stop shelter located in front of the Red Line station, crashed into the station and traveled 15 feet up the station's stairwell, Fire Media Affairs Director Larry Langford said.
Both women died of multiple injuries from a semi truck striking a CTA train station. Both deaths were ruled accidents, according to the Cook County Medical Examiner’s office.
Due to Wells’ negligence, Brown was struck and killed by the semi truck. Brown suffered serious injuries, including traumatic brain injuries and multiple trauma injuries to her body, causing a slow death, the suit said.
Wells, of the 3100 block of South Lapeer Road in Metamora, Mich., was cited for negligent driving, a local municipal charge, police said.
The suit is asking for an unspecified amount of money in the case, “in excess” of the court’s jurisdictional limits.
