Woman sues ex for posting private 'x-rated' photos online



CHICAGO (STNG)  -- A woman filed a lawsuit against her ex-boyfriend Wednesday after he allegedly posted “intimate and personal” pictures of her on the Internet after the couple broke up.

Jessica Voth and Miles Marsh started dating in September of 2003, according to the suit filed in Cook County Circuit court Wednesday.

The couple met while attending Lake Forest College in Lake Forest, where Voth was a sophomore and Marsh a senior, the suit said. While they were dating, Marsh allegedly made repeated requests to take intimate and personal photographs of Voth—she “begrudgingly” allowed him to do so.

On Valentine’s Day of 2006, the couple broke up. Voth, knowing her ex possessed the photographs, asked him to destroy any photos or computer files of her. Marsh allegedly told her he would keep he pictures private, but refused to destroy them.

On Oct. 5, 2006, however, Marsh allegedly posted the photos online, to a web site called exgfpics.com, which allegedly averages 178,920 visits per day, the suit said.

It wasn’t until Nov. 26, 2008 that Voth realized the photos had been released, when a friend from high school said he saw “x-rated” photos of her online. The site, which boasts “Submitted Photos Of Nude Ex Girlfriends & Former Wives” was initially seen by another friend-of-a-friend, on tour in Iraq.

The comments posted near her picture on the site were allegedly “explicit, offensive and degrading” to Voth.

When she contacted Marsh about the photos, he allegedly ignored her. Ultimately, he sent her a text message asking that she leave him alone, the suit said.

The suit accuses Marsh of intentional torture, claiming his actions caused Voth emotional distress, humiliation and mental anguish. She allegedly did not leave her condominium for more than a month after discovering the photos and fell behind at work.

The suit calls Marsh’s behavior “cruel and malicious” and also "betrayal." It accuses Marsh of invasion of privacy and intentional infliction of emotional distress. It asks for an undisclosed amount of money in damages.
